Driver Entry

I release from liability and waive my right to sue the NorCal Miata Time Trial Challenge event organizers and staff, including its sponsors, affiliates, subsidiaries, officers, directors, employees, customers, distributors, independent contractors, suppliers, agents, successors and assigns, (hereafter referred to as ‘NorCal Miata Time Trial Challenge’) for any and all claims, including claims of NorCal Miata Time Trial Challenge’s negligence, for any physical injury, illness, death, or economic loss I may suffer or which may result from my participation in NorCal Miata Time Trial Challenge events, travel to and from the events, or any activities incidental to the events. Participant is fully aware that NorCal Miata Time Trial Challenge and/or its sponsors and event hosts do not cover liability associated with the events. At the event premises and both during and after the event, any injury to, or caused by the Participant will be the Participant’s sole and exclusive responsibility. Participant shall be solely and exclusively responsible for any losses, liabilities, costs, or property damage, personal or private, which the individual may cause during the course of an activity. Participant agrees to indemnify, defend and hold NorCal Miata Time Trial Challenge harmless from and against all actions, suits, proceedings, judgments, demands, claims, liabilities, losses or expenses whatsoever (including reasonable attorney's fees) incurred in connection with or arising from the NorCal Miata Time Trial Challenge events, the support vehicle(s), the sponsored parts and consumables, the activities or omissions of drivers or team members or the activities or omissions of NorCal Miata Time Trial Challenge including, without limitation: • Any claim falling within the Participant’s own insurance coverage; • Any claim or action for or relating to personal loss, injury, death, property damage or otherwise, suffered by participants, competitors (such as the drivers), spectators or other persons at any of the events or team meetings or activities relating to NorCal Miata Time Trial Challenge. By signing below, I certify that I have read, understood, and agree to all terms and conditions outlined above.

I am aware that driving or riding in an automobile or motorcycle on a race track, whether in a race, time trial, or driver education program, for practice, testing, or otherwise, is a hazardous activity involving a high-degree of risk of serious injury or death. I am voluntarily participating in such activities with knowledge of the danger involved and hereby agree to assume any and all risks of injury or death resulting from this activity.
